Terms of Service - Free Business License

1. Service Provider

The service provider is Defguard Sp. z o.o., with its registered office in Szczecin, Poland, at ul. Cyfrowa 6/317, 71-441 Szczecin. The company is entered into the National Court Register under KRS number 0001168794, with EU VAT number PL851-332-92-06.

2. Scope of Terms & License Acceptance

  • These Terms apply exclusively to the provision and usage of the free Business Defguard license.
  • Acceptance of these Terms of Service and the use of the free Business Defguard license constitutes automatic acceptance of the Defguard Enterprise License, available at: Defguard Enterprise License.

3. License Terms & Delivery

  • Authorized Use: The free license is issued strictly and exclusively for the internal use of the company or private individual who registered via the form on the defguard.net website.
  • Non-Transferable: There is no possibility of resale, transfer, or use of the license by any other entity or third party.
  • Subscription Model: The license is issued in the form of a free monthly subscription. It is granted for a period of one month and is automatically renewed every month.

4. Consideration and Marketing Rights

  • Mutual Exchange: The Business Defguard license is provided free of monetary charge. In consideration for this free access, the Licensee grants Defguard Sp. z o.o. a worldwide, royalty-free, non-exclusive right to use the Licensee’s company name and logo in marketing materials (including on the defguard.net website) strictly to identify the Licensee as a user of the software.
  • Termination of Agreement: This arrangement is fundamental to the provision of the free license. If the Licensee no longer wishes to grant this right to use their name and logo, they must terminate this free license agreement by contacting support@defguard.net. Upon termination, the right to use the software under this free tier will be immediately canceled, and Defguard Sp. z o.o. will remove the Licensee’s name and logo from its marketing materials within a reasonable timeframe.

5. Support Services

  • No paid or dedicated support services are provided under the free license.
  • To access professional support, technical assistance, or SLA-based services, the user must purchase a paid Business or Enterprise license.

6. Limitations of Liability

  • The free license and associated software are provided “as is” without warranties of any kind, express or implied.
  • The service provider is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use the services or the software.

7. Changes to Terms

Changes to these Terms take effect 24 hours after their publication on the website.

8. Governing Law and Jurisdiction

These Terms are governed by Polish law. Any disputes arising from or related to these Terms will be resolved by the courts competent for the service provider’s registered office in Szczecin, Poland.
